Welcome to "Foodie Choice" (hereinafter referred to as "this Service"). This Service is provided by HungChe Hsu (hereinafter referred to as "the Developer"). Please read the following Terms of Service carefully before using this Application. By installing, registering, or utilizing this Service, you acknowledge that you have read, understood, and fully agreed to all provisions herewithin. These terms constitute a legally binding agreement between you and the Developer. If you do not agree to these Terms of Service, please stop using this Service immediately and uninstall this Application.
1. Description of Services & Platform Architecture
This Service provides restaurant searches and filtering, a random spinner, map navigations, customized favorites synchronization, collaborative dining decision rooms (blind voting, tie-breakers), and gathering schedule management. This Service consists of free functionalities and a paid premium tier (Foodie Pro).
To ensure optimal system performance and data security, this Service fully utilizes Supabase cloud database and authentication infrastructure. The Developer reserves the right to modify, upgrade, suspend, limit, or terminate all or part of this Service at any time for maintenance or business adjustment without prior notice.
2. Account Security & OTP Verification
This Service utilizes an email One-Time Password (OTP) verification mechanism integrated with Supabase. Users are responsible for ensuring the authenticity and security of their email address, as well as keeping their verification codes confidential. All actions performed through your account and device will be deemed as your own. The Developer shall not be held liable for any loss of data, favorites, or damages resulting from unauthorized account access or compromised email accounts.
3. Subscription Terms, Payments, and Refund Disclaimers (Critical)
By subscribing to the paid premium tier "Foodie Pro," you fully understand and agree to the following billing and refund terms:
- Third-Party Payment Gateway: All subscriptions, automatic renewals, and transactions are entirely processed and managed by Apple App Store (for iOS) or Google Play Store (for Android). The Developer does not collect, process, access, or store your credit card numbers, payment passwords, or any detailed billing information.
- Automatic Renewal: Subscription fees will be billed via your Apple ID / Google Play Account. Subscriptions automatically renew monthly or annually unless canceled at least 24 hours prior to the end of the current billing cycle. Uninstalling the App or deleting your account does not cancel your subscription; you must cancel it manually through the platform account settings.
- Exclusion of the 7-day Cooling-off Period (Taiwan Consumer Protection Act): The paid subscription service (Foodie Pro) is classified as "digital content not supplied on a tangible medium or online services completed upon provision" under Article 19, Paragraph 2 of the Taiwan Consumer Protection Act. Once purchased and activated with your consent, the Service starts immediately, and the 7-day unconditional cancellation or refund policy (cooling-off period) is strictly excluded.
- Refund Policy & Disclaimer: All paid subscription funds are collected by Apple or Google. The Developer has no technical authority or administrative power to review, handle, or issue any refunds. If you demand a refund due to billing disputes, accidental subscription, or failure to cancel auto-renewals, you must submit a refund request directly to Apple or Google following their official procedures. The Developer makes no guarantees regarding refund approvals and accepts no liability for payment disputes.
- Pricing adjustments: The Developer reserves the right to adjust subscription pricing or free tier limits (such as daily search quotas) in response to server costs. Pricing changes will take effect at the start of the next billing cycle.
4. Third-Party Data & Restaurant Information Disclaimers (Critical)
This Service aggregates restaurant information provided by third-party APIs (including Google Maps API, Google Places API, and Apple MapKit). By using this Service, you acknowledge and agree to the following disclaimers:
- Information is for Reference Only: All restaurant names, addresses, business hours, locations on maps, rating scores, menu photos, and business statuses are retrieved from third-party APIs or public sources. The Developer makes no warranty regarding the absolute accuracy, completeness, real-time status, or reliability of such data.
- Third-Party Maps Navigation Disclaimer: The restaurant routing and location features of this Service redirect to independent third-party navigation providers (such as Google Maps or Apple Maps). The accuracy, safety, and real-time conditions of such routes are managed solely by these providers. The Developer assumes no legal or financial liability for any physical injury, delays, financial loss, or property damage occurred during transit due to navigation errors or accidents.
- No Liability for Trips or Dining Disputes: Restaurants may close down, relocate, change business hours, or modify menus at any time without our immediate knowledge. Users must verify details directly with the restaurant before traveling. The Developer assumes no responsibility for any direct or indirect loss or damages (such as wasted travel time, transport costs, or dining disputes) resulting from inaccurate or delayed information provided by this Service.
- Decision Features Disclaimer: The dining decision rooms (voting, tie-breakers) and random spinner are provided purely as collaborative tools for entertainment and reference. Their outcomes hold no binding or legal authority, and the Developer shall not be held liable for any disputes among gathering participants or the quality/pricing of chosen restaurants.
5. Minor User Policy & Guardian Consent
If you are a minor under the age of 18 (or the legal age of majority in your jurisdiction), you must obtain prior permission and consent from your parent or legal guardian before downloading, registering, logging in, or using this Service (including subscribing to Foodie Pro). By using this Service, it is deemed that your parent or guardian has read, understood, and agreed to all terms, accepting legal liability for all your transactions and actions in the App.
6. User Conduct Guidelines
Users must comply with all applicable local and international laws. You shall not use this Service for any unlawful activities, including but not limited to:
- Reverse engineering, decompiling, disassembling, or attempting to extract any source code or network packets of this Service.
- Utilizing any automated tools, scrapers, bots, or load testing programs to overload or interfere with server performance or API usage.
- Posting violent, pornographic, hateful, defamatory, or fraudulent content within dining voting rooms or group features.
- Maliciously creating large numbers of empty voting rooms or interfering with other users' decision-making processes.
7. Prohibition of Malicious Attacks & Cloud Cost Indemnification
[CRITICAL LIABILTY & DAMAGE STATEMENT]
This Service is built on scalable cloud services billed on a pay-as-you-go basis. We strictly prohibit any form of malicious cyber attacks or server abuse, including but not limited to:
- Distributed Denial of Service (DDoS) attacks or trying to overload our servers.
- Sending disproportionate, automated, or looping queries to APIs (e.g., Google Places API) or databases (Supabase), or attempting to brute-force PIN codes.
- Attempting to bypass subscription logic, quota checks, or security filters.
If a user's malicious activities (whether intentional or due to gross negligence, or compromised credentials) cause our cloud hosting infrastructure (Supabase, Google Maps API, etc.) to incur abnormally high billing charges or system damages, the user shall be held fully liable for all associated costs. The user agrees to fully indemnify the Developer for all direct and indirect losses (including reasonable investigation expenses, system recovery costs, and attorney fees). The Developer reserves the right to immediately terminate the user's account and block access without refunds, and pursues all legal remedies.
8. Service Interruptions & Server Maintenance
This Service relies entirely on third-party cloud infrastructure (Supabase, App Store, etc.) and Internet connectivity. If the Service experiences delay, data loss, or temporary/permanent unavailability due to server crashes, database corruption, network outages, maintenance upgrades, hacker attacks, or force majeure events, the Developer is exempted from all civil and criminal liabilities to the maximum extent permitted by law. Users are advised to keep external records of their essential lists and schedules.
9. Privacy Protection
We respect your privacy. All details regarding data collection and processing are governed by our 《Privacy Policy》, which is incorporated into and forms an integral part of these Terms.
10. Intellectual Property Rights
All source code, UI designs, graphics, trademarks, and brand names (食決 ShiJue / Foodie Choice) of this Application are the exclusive property of the Developer. No unauthorized replication or commercial exploitation is permitted.
11. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan). Any legal action or dispute arising from these Terms or the use of this Service shall be submitted exclusively to the Taiwan Taoyuan District Court as the court of first instance.
